
# RustMailer License Agreement (v1.0)

## 1. Definitions

- **“Software”** refers to RustMailer, including all versions, components, source code, binaries, updates, patches, documentation, and related materials.
- **“You”** or **“User”** refers to any person or legal entity installing, accessing, or using the Software.
- **“Instance”** means a single deployment of RustMailer on a server, container, or VM, regardless of the number of email accounts it serves.
- **“License Key”** refers to a unique code issued by the Author that enables full usage of the Software beyond the trial period.
- **“Author”** refers to the creator of RustMailer. At present, the project is maintained by an individual. The ownership may be transferred to a legal entity (e.g., a UK-based company) in the future without affecting existing license holders.

## 2. License Grant

Subject to the terms of this agreement, the Author grants you a non-exclusive, non-transferable, non-sublicensable, revocable license to use the Software for your own business or personal needs.

You may:

- Use the Software on any number of production instances within your personal or organizational infrastructure under a valid License Key.
- Use the Software without a License Key during a 14-day free trial period, for evaluation purposes.
- Use the Software for internal development, testing, or non-commercial research activities.
- Embed the Software as a component within your own applications or services for internal business purposes, including use by your customers or end users.

## 3. Restrictions

You may **not**, without prior written consent:

- Share, lease, sublicense, resell, or redistribute the Software or any part thereof.
- Modify or circumvent the license verification mechanism.
- Host RustMailer as a public or commercial service for third parties (e.g., SaaS or white-label) without a commercial license agreement.
- Remove or obscure copyright, attribution, or license notices.
- Share a License Key with third parties outside your organization.

## 4. Source Code Access

RustMailer’s complete source code, including frontend and backend, is publicly accessible at [https://github.com/rustmailer/rustmailer](https://github.com/rustmailer/rustmailer).

You are granted the rights to:

- Inspect, download, compile, and run the software for your own personal or organizational use, subject to license validation and compliance with this License Agreement.
- Audit the code for security and compliance purposes.

However, you may not:

- Fork, clone, or otherwise create derivative works for the purpose of developing a competing product or providing a commercial hosted service based on RustMailer.
- Rebrand, redistribute, or publicly release modified or unmodified versions of the source code.
- Use the source code to offer software-as-a-service (SaaS) or any commercial services to third parties without explicit written permission.
- Remove or alter copyright, licensing, or attribution information in the source code or binaries.
- Bypass, disable, or circumvent any license validation or usage restrictions enforced by the software.

All usage of the source code is subject to the terms of this License Agreement.


## 5. License Key Terms

- License Keys are issued upon purchase and are tied to your subscription.
- Each License Key is valid for use on any number of production instances within your personal or organizational infrastructure.
- You must not share License Keys outside your organization.
- Expired or revoked License Keys will disable access to the Software after a grace period of 30 days.

## 6. Termination

This License will terminate automatically if:

- You fail to comply with any part of this Agreement.
- You use an invalid or revoked License Key.
- You attempt to reverse-engineer, bypass, or disable any licensing-related code.

Upon termination, you must stop using the Software and delete all related files from your systems.

## 7. Ownership and Intellectual Property

The Software is licensed, not sold. The Author retains all rights, title, and interest in and to the Software, including all intellectual property rights.

## 8. No Warranty

THE SOFTWARE IS PROVIDED “AS IS”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.  
THE AUTHOR DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SOFTWARE WILL BE ERROR-FREE OR UNINTERRUPTED.

## 9. Limitation of Liability

To the fullest extent permitted by law, the Author shall not be liable for:

- Any indirect, incidental, special, consequential, or punitive damages.
- Any loss of revenue, profits, or data arising from the use or inability to use the Software.
- Any claims exceeding the amount paid by the user for the license during the 12 months prior to the claim.

Note: The Author offers a satisfaction guarantee through the official website, allowing unconditional refunds within the subscription period.  
This License’s limitation of liability clause does not affect such refund policies.


## 10. Governing Law and Jurisdiction

This Agreement shall be governed by the laws of the United Kingdom (or the Author’s country of residence if no company is formed).  
Any disputes shall be resolved by the competent courts in London, UK, unless otherwise agreed.

## 11. Privacy and Data

RustMailer does **not** collect, transmit, or store any user data or email content.
Once installed, RustMailer runs entirely within your own environment and is fully isolated from the Author’s servers or website.
No telemetry, usage data, or personal information is sent to or collected by the Author or any third parties.

## 12. Updates and Changes

- The Author reserves the right to change or update this License Agreement at any time.
- Continued use of the Software after such changes constitutes your acceptance.

## 13. Acceptance

By installing or using RustMailer, you acknowledge that you have read, understood, and agreed to be bound by this License Agreement.
